Agreement to these terms

These Terms of Use govern your access to and use of the website amaurim.pro and any order you place with Amaurim through it. By browsing the site, submitting an enquiry or placing an order, you accept these terms. If you do not accept them, please do not use the site.

In these terms, “Amaurim”, “we”, “us” and “our” mean Amaurim, of 765 N 10500 W, Ogden, UT 84404, United States. “You” means the person accessing the site or placing an order. If you are using the site on behalf of a business, you confirm that you have authority to bind that business to these terms.

You must be at least eighteen years old, or the age of majority where you live, to place an order with us.

Permitted use of the website

You may use amaurim.pro to learn about our products and services, request advice, and place orders for your own household or business use. In using the site you agree not to:

• Attempt to gain unauthorised access to the site, its server or any connected system.
• Introduce malicious code, or interfere with the availability or integrity of the site.
• Scrape, harvest or systematically extract content or images for republication or model training without our written permission.
• Use the site to transmit unlawful, deceptive, defamatory or infringing material.
• Misrepresent your identity, or place orders using payment details you are not authorised to use.
• Reverse engineer, frame or mirror the site, or remove any proprietary notice from it.

We may suspend or withdraw access to the site, in whole or in part, where we reasonably believe these terms have been breached, or where we need to for maintenance or security reasons.

Products, descriptions and pricing

We describe our products as accurately as we can, including measured specifications rather than marketing approximations. Photographs are representative; natural materials such as timber, stoneware and woven fibre vary in grain, glaze and tone between individual items, and slight variation of that kind is a characteristic of the product rather than a defect.

All prices are shown in United States dollars and exclude sales tax and delivery unless expressly stated. Tax is calculated at checkout according to your delivery address. Delivery is free on qualifying United States orders above seventy-five dollars; below that threshold a flat delivery charge is shown before you confirm the order.

We aim to keep pricing and availability accurate but errors occasionally occur. If a product is listed at a materially incorrect price, or is unavailable after you have ordered, we will contact you to offer the item at the correct price, propose an alternative, or cancel the affected line and refund you in full. We are not obliged to supply at an obviously erroneous price.

Stock figures are indicative rather than a guarantee. Because we buy in limited, tested batches, some lines sell out and are not repeated.

Orders, acceptance and payment

Your order is an offer to purchase. A contract is formed only when we send a dispatch confirmation for the items in question; an automated order acknowledgement does not itself create a contract. We may decline an order where the item is unavailable, where we cannot authorise payment, where we suspect fraud, where the delivery address falls outside the areas we serve, or where quantities suggest resale in breach of these terms.

Payment is taken at the time of order through our payment processor. We accept major credit and debit cards. Card details are handled entirely by the processor and are not stored on our systems. Approved trade accounts may operate on net-30 terms as separately agreed in writing.

Title and risk in the goods pass to you on delivery to the address you supplied. Please inspect your delivery promptly and tell us about any shortage or damage within a reasonable period so that we can resolve it quickly.

Delivery, returns and warranty

We dispatch from our Ogden facility within forty-eight hours of order approval on business days and ship to all fifty United States states. Transit times quoted at checkout are estimates provided by the carrier; we are not liable for delay caused by weather, carrier disruption or events outside our reasonable control, but we will help you trace and resolve any late parcel.

Returns

You may return most items within sixty days of delivery for a refund or exchange, provided they are in resaleable condition with their original packaging. We pay return shipping where an item is faulty, damaged in transit or incorrectly supplied. Where a return is simply a change of mind, you cover return shipping. Refunds are issued to the original payment method, normally within five business days of the goods reaching us. Fabric samples, clearance items sold as seconds and custom-fabricated storage systems are excluded from the change-of-mind return right, although your statutory rights regarding faulty goods are unaffected.

Warranty

We provide a two-year warranty against defects in materials and workmanship under normal household use, running from the delivery date. Within that period we supply replacement parts free of charge, or replace the product if a repair is not practical. The warranty does not cover ordinary wear, accidental damage, misuse, commercial use beyond the product's stated rating, thermal shock, or damage caused by cleaning methods contrary to the care instructions supplied. To claim, contact our support team with your order number and a description of the fault, including a photograph where possible.

Intellectual property

The Amaurim name, logo, page designs, written content, product descriptions and photography on this site are owned by Amaurim or used under licence, and are protected by copyright, trade mark and other intellectual property laws. You may view the site, and print or download individual pages for your own non-commercial reference.

You may not otherwise reproduce, adapt, distribute, publish or commercially exploit our content without our prior written consent, and you may not use our name or logo in a way that suggests endorsement or affiliation where none exists. Photographic material is licensed to Amaurim for use on this website and may not be extracted for separate use.

If you send us photographs, measurements or suggestions in the course of an enquiry, you grant us permission to use that material for the purpose of answering you and fulfilling your request. We will not publish material you have sent us without asking you first.

Disclaimers and limitation of liability

The website and its content are provided for general information. We take care to keep the site accurate and available, but we do not warrant that it will be uninterrupted, error-free or free from harmful components, and we do not warrant that guidance given on the site will suit every household circumstance. Advice on organisation, sizing or care is offered in good faith; you remain responsible for confirming that a product suits your own space and intended use.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Nothing in these terms affects your non-excludable statutory rights as a consumer.

Subject to that, and to the maximum extent permitted by applicable law, Amaurim is not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, data or goodwill, arising out of your use of the website. Where we are found liable in connection with an order, our total liability is limited to the amount you paid for the goods giving rise to the claim.

Privacy, cookies and external links

Our handling of personal information is described in our Privacy Policy, and the cookies we use, together with your controls over them, are described on our Cookie Preferences page. Both documents form part of your agreement with us.

Where this site links to an external website, that link is provided for convenience only. We do not control third-party sites and are not responsible for their content, accuracy, security or privacy practices. You should review the terms and privacy policy of any external site you choose to visit.

Governing law, changes and contact

These terms are governed by the laws of the State of Utah and the applicable federal laws of the United States, without regard to conflict of laws principles. The state and federal courts located in Utah have jurisdiction over any dispute arising from them, although we will always try to resolve a complaint directly with you first.

We may update these terms to reflect changes in our products, operations or legal obligations. The version published on this page at the time you place an order is the version that applies to that order. If a provision of these terms is found unenforceable, the remaining provisions continue in full effect.
